These Terms govern your use of the Waha application and services. By creating an account or using Waha, you agree to these Terms. If you do not agree, please do not use the app.
1. What Waha is
Waha is an online marketplace that connects customers with independent gardeners and vendors ("Gardeners") in Kuwait and the GCC. Waha provides the platform; the gardening services and products are provided by the Gardeners, not by Waha. Waha is not a party to the service itself.
2. Eligibility & accounts
You must be at least 18 years old and provide accurate information.
You are responsible for keeping your account credentials secure and for all activity under your account.
Gardeners must complete identity and payout verification before offering services.
3. Bookings, orders & packages
Customers pay for a service booking, product order, or package deal through the app before it is placed.
A package is a balance of sessions bought up front; sessions are scheduled one at a time and delivered by the Gardener.
The Gardener confirms and fulfils the request. For services, a completion photo is required.
4. Payments, commission & payouts
Payments are processed securely via Hesabe (KNET and cards).
Waha charges a platform commission (a percentage of each completed order, as shown in the app) which is deducted from the Gardener's earnings.
Gardener earnings are held in their in-app wallet and paid out to their registered bank account upon request, typically within 1 to 15 days.
A product order counts toward a Gardener's earnings only once it is marked Delivered.
5. Cancellations & refunds
A customer may cancel a booking or order before the Gardener confirms it; the amount is refunded instantly to the customer's in-app Waha wallet.
After confirmation, cancellations are subject to the applicable timing rules shown in the app.
Wallet balances may be used within the app.
6. Gardener obligations
Provide services professionally, safely, and as described.
Keep listings, pricing, availability, and stock accurate.
Upload a genuine completion photo for each completed service.
Comply with all applicable laws and licensing requirements.
7. Acceptable use
You agree not to misuse the app, including: posting false or unlawful content, infringing others' rights, attempting to bypass payments, harassing other users, or interfering with the service's operation. We may suspend or remove accounts that violate these Terms.
8. Content you upload
You retain ownership of content you upload, and grant Waha a licence to host and display it for the purpose of operating the service. You are responsible for ensuring you have the rights to any content you post.
9. Disclaimers & liability
Waha provides the platform "as is". We do not guarantee the quality, safety, or legality of services provided by Gardeners, who are independent providers. To the maximum extent permitted by law, Waha is not liable for indirect or consequential damages arising from services arranged through the app. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Account termination
You may delete your account at any time from the app. We may suspend or terminate accounts that breach these Terms or applicable law.
11. Governing law
These Terms are governed by the laws of the State of Kuwait, and disputes are subject to the jurisdiction of the Kuwaiti courts.
12. Changes to these Terms
We may update these Terms from time to time. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.
